1.1 You must be at least the age of majority in your province or territory of residence and capable of forming a binding contract. 1.2 You agree to provide accurate and complete information and to keep it up to date, including for identity verification purposes required under Canadian telecommunications regulations. 1.3 We may refuse, suspend, or terminate service at our discretion for fraud, non-payment, or breach of these Terms, subject to the notice requirements of the Wireless Code.

2.1 Unlimit Mobile provides prepaid and/or postpaid wireless voice, text, and data services operating on the Host Network. Coverage, speed, and quality depend on the Host Network and third-party roaming partners, and are not guaranteed. 2.2 Coverage maps are estimates only, consistent with Wireless Code disclosure requirements, and not a guarantee of service at any specific location.

3.1 Contract Cap. In accordance with the Wireless Code, if you enter into a fixed-term contract, the terms restricting your ability to leave (including any device financing) will not extend beyond 24 months, and after 24 months you may cancel without early cancellation penalties on the service portion of your contract. 3.2 Contract Summary. You will receive a clear, one-to-two-page summary of your key contract terms and a copy of the full contract in the format you choose (electronic or paper) at no charge. 3.3 Unlocking. Devices sold by Unlimit Mobile will not be locked, or will be unlocked free of charge upon request, in compliance with the Wireless Code's device unlocking obligations. 3.4 Data Overage and Roaming Caps. We will notify you when you reach 50%, 80%, and 100% of your data, and any additional data/roaming charges included in your plan, and will cap additional data overage charges at $50/month and international roaming charges at $100/month unless you expressly opt in to exceed these caps. 3.5 Trial Period. You may cancel a new contract within 15 days (or 30 days in Quebec, per the Consumer Protection Act) without penalty if you have used less than the applicable usage threshold set by the Wireless Code/provincial law, and return any device in near-new condition for a refund less a reasonable usage fee.

4.1 Current pricing and features are listed at www.unlimitmobile.com. All fees are exclusive of applicable federal (GST/HST) and provincial (PST/QST) sales taxes and regulatory fees (e.g., 9-1-1 fees), which will be added to your invoice. 4.2 Prepaid Plans: Service operates on a pay-in-advance basis. Balances and included features expire at the end of the billing cycle unless renewed, subject to any minimum validity periods required by provincial consumer protection law. 4.3 Postpaid Plans: You authorize recurring charges to your designated payment method. We will provide bills in plain language as required by the Wireless Code. 4.4 Refunds are provided as required by the Wireless Code, applicable provincial consumer protection legislation, or as expressly stated in your plan terms.

5.1 "Unlimited" plans are subject to fair use and network management policies, including data throttling/deprioritization after a disclosed threshold, particularly in periods of network congestion, consistent with CRTC net neutrality rules. 5.2 Commercial resale, machine-to-machine use, or use inconsistent with typical consumer patterns on a consumer plan is prohibited unless expressly permitted by your plan.

6.1 You are responsible for ensuring compatibility of any device brought to Unlimit Mobile with the Host Network's technical requirements (including band compatibility and VoLTE/HD Voice support). 6.2 Lost, stolen, or damaged SIM/eSIM replacements may incur a fee as disclosed at time of request.

7.1 You may port a number to or from Unlimit Mobile in accordance with CRTC wireless number portability rules, generally completed within a few hours for compatible requests. 7.2 We do not charge for porting your number away from Unlimit Mobile.

8.1 Where technically supported by the Host Network, 9-1-1 calling may be unavailable during outages, in areas without coverage, or when your device lacks power or signal. 8.2 It is your responsibility to have an alternative means of contacting emergency services if Services are unavailable.

You agree not to: (a) violate applicable law, including Canada's Anti-Spam Legislation ("CASL"); (b) transmit unlawful, harassing, or fraudulent content; (c) interfere with the Host Network; (d) engage in SIM-swap fraud or unauthorized account access; or (e) resell Services without our written authorization.

10.1 Our collection, use, and disclosure of your personal information is governed by our Privacy Policy at www.unlimitmobile.com/privacy-policy, which complies with the Personal Information Protection and Electronic Documents Act ("PIPEDA") and applicable provincial privacy legislation (e.g., Quebec's Law 25). 10.2 Quebec residents: this agreement and related documents may be provided in French upon request, in accordance with Quebec's Charter of the French Language (Bill 96) / [Il est possible d'obtenir ce document en français sur demande.].

TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. NOTHING IN THESE TERMS LIMITS ANY WARRANTY OR CONDITION IMPLIED BY LAW THAT CANNOT LAWFULLY BE EXCLUDED, INCLUDING UNDER PROVINCIAL CONSUMER PROTECTION STATUTES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNLIMIT MOBILE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID FOR SERVICES IN THE THREE (3) MONTHS PRECEDING THE CLAIM. THIS SECTION DOES NOT LIMIT LIABILITY WHERE PROHIBITED BY APPLICABLE PROVINCIAL CONSUMER PROTECTION LAW (INCLUDING QUEBEC'S CONSUMER PROTECTION ACT).

13.1 We encourage you to first contact our Customer Support team to resolve any dispute. If unresolved, you may escalate to the Commission for Complaints for Telecom-Television Services ("CCTS"), an independent complaint-resolution body, free of charge, at www.ccts-cprst.ca. 13.2 Nothing in these Terms limits your right to bring a claim in small claims court or, in Quebec, exercise your rights under the Consumer Protection Act. Mandatory arbitration clauses that would prevent you from accessing the courts are not enforced against consumers where prohibited by provincial law.

We may modify these Terms, pricing, or features. Material changes will be communicated with at least 30 days' advance notice as required by the Wireless Code, via email, SMS, or account notification, and you may cancel without penalty if you do not accept a materially adverse change.

We may suspend or terminate Services for non-payment, fraud, or breach of these Terms, subject to the notice periods required by the Wireless Code. You may cancel at any time; early cancellation fees, if any, will not exceed the balance of any device subsidy being recovered, amortized over a maximum 24-month period.

These Terms are governed by the laws of Canada and the applicable provincial laws therein.
